Erksales Hardware becomes the second company, after Tri Oceans Investments, to approach the High Court this year seeking compensation over alleged non-delivery of products purchased from PPC.

PPC and its employee, Nicole Botha, are cited as the first and second respondents in the matter.

According to the application, Erksales Hardware purchased 11 truckloads of cement, each carrying 30 tonnes, through a PPC sales representative last year. However, the hardware business alleges that the consignment was never delivered.

The cement is currently valued at US$72,600.

The dispute is scheduled to return to the High Court on November 6, when Justice Bongani Ndhlovu is expected to hear Erksales Hardware’s application to have the case reinstated.

A court notice issued on October 14 listed the matter under case number HCBC835/26.

The initial application was dismissed after Botha opposed it, prompting Erksales Hardware to file an application seeking reinstatement of the case.

However, the court notice does not explain why the original application was dismissed or provide details of the arguments raised by the respondents.

The November hearing will determine whether the matter can be restored to the court roll. If the application succeeds, the substantive dispute will proceed, with further hearing dates to be determined by the court.

In July this year, Tri Oceans Investments also took PPC to court over a similar dispute. The two parties subsequently agreed to resolve the matter out of court.
