ZRP Warns Against Exploiting Kuwadzana Tragedy

The Zimbabwe Republic Police (ZRP) has issued a stern warning against individuals exploiting the recent Kuwadzana children’s tragedy to commit fraud and mobilize for illegal gatherings.

 

In a statement released today, police spokesperson Commissioner Paul Nyathi said criminals were soliciting money through Ecocash and InnBucks accounts linked to one Josphine Mutongi, claiming the funds would assist affected families, support protests over alleged missing body parts, and organize demonstrations.

 

“The families of the victims have disowned Josphine Mutongi, who is openly using social media platforms to create confusion among Zimbabweans,” Nyathi said.

 

The ZRP clarified that, contrary to the online claims, there is no evidence that one or all of the victims had missing body parts.

 

A full post-mortem is scheduled to be conducted in Harare on 6 October 2025, and results will be made public in consultation with the bereaved families.

 

Commissioner Nyathi emphasized that anyone inciting violence or illegal gatherings will face the full force of the law.

“The law will definitely take its course without fear or favour,” he said, urging the public to respect the privacy of grieving families and allow investigations to proceed.

The police reiterated their commitment to uncovering the circumstances surrounding the tragedy while safeguarding public order.

Sir Wicknell Chivayo’s former wife, Sonja Madzikanda, together with her mother, Tabitha Madzikanda, were remanded in custody pending a bail hearing scheduled for tomorrow after appearing in court on cyberbullying charges.

The pair is accused of circulating AI-generated images allegedly depicting Sonja’s former husband, Wicknell Chivayo, alongside South African President Cyril Ramaphosa.

According to court proceedings, the two were formally charged before being remanded in custody. They are expected to return to court tomorrow for the determination of their bail application.

Judge Throws Out Marry Mubaiwa’s Application in VP Chiwenga Case

The High Court has thrown out an application by Marry Mubaiwa seeking a permanent stay of proceedings in a case where she is accused of attempting to murder her former husband, Vice-President Constantino Chiwenga.

Justice Jacob Manzunzu ruled against Mubaiwa’s application, which had cited Harare regional magistrate Feresi Chakanyuka and the Prosecutor-General as respondents, saying the arguments raised lacked merit.

In his ruling, Justice Manzunzu said the purpose of an investigation is to establish the truth and determine whether there had been unreasonable delays in the matter. He noted that a court could rely on either a formal or informal inquiry, depending on the circumstances.

He added that where the court record already contains all the necessary facts, there is no need for oral evidence, as the matter can be adequately determined from the documents before the court.

The judge also ruled that the magistrate had properly considered issues relating to delays both before and after the commencement of trial proceedings. He said higher courts should only interfere in limited circumstances and found no gross irregularities in the handling of the matter.

Justice Manzunzu further observed that the delays in the case were largely linked to Mubaiwa’s need for medical treatment, which prevented the trial from proceeding.

Mubaiwa had approached the High Court seeking a review of Magistrate Chakanyuka’s earlier decision dismissing her application for a permanent stay of prosecution.

She was arrested in December 2019 and later filed the application in November 2024 under Section 167A of the Criminal Procedure and Evidence Act, arguing that there had been excessive delays in concluding the criminal case.

However, the National Prosecuting Authority opposed the application, maintaining that the postponements were not caused by the State.

In her earlier ruling, Magistrate Chakanyuka concluded that the delays stemmed mainly from Mubaiwa’s circumstances rather than prosecutorial conduct.

Mubaiwa had argued that the magistrate committed procedural irregularities by dismissing her request without carrying out what she described as a mandatory investigation under the law.

She also challenged the finding that only delays primarily attributable to the State could justify a permanent halt to prosecution.

Anymore Zvitsva Sentenced to 89 Years in Jail

A Harare court has sentenced 35-year-old convicted rapist Anymore Zvitsva to 89 years in prison after he was found guilty of multiple offences, including rape, attempted murder, and robbery.

According to court records, Zvitsva was convicted on four counts of rape, five counts of attempted murder, and one count of robbery.

He admitted to all 10 charges during his appearance before Harare regional magistrate Francis Mapfumo last week.
